Please review the following Terms and Policies (hereinafter referred to as the “Terms”). Your use of, and purchase from, WWW. COLORMENDING.COM and KASEN-KELLS CONSULTING, LLC DBA COLOR MENDING THERAPY (hereinafter referred to as the “Site” and the “Seller,” respectively) are subject to these Terms. By purchasing a product from the Seller, you are subject to the Terms.
THESE TERMS INCLUDE A DISPUTE RESOLUTION CLAUSE FOR ARBITRATION. ARBITRATION PROVIDES YOU WITH LESS DISCOVERY AND APPELLATE REVIEW OPTIONS THAN YOU WOULD BE ENTITLED TO IN COURT. YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL. YOU CAN LEARN MORE IN SECTION 13. PLEASE REVIEW IT CAREFULLY AND IN ITS ENTIRETY.
YOUR CONSENT

If you are under the age of 18, or you do not agree with the Terms as stated herein, please STOP now and do not purchase from the Seller. By purchasing, you agree to the Terms as stated herein, regardless of whether or not you have read the Terms

This Site and anything purchased from the Site and/or the Seller are provided on an “as is” basis and without warranties of any kind, neither express or implied, to the extent permitted by law.
The Site and the Seller disclaims implied warranties of merchantability and fitness for a particular purpose.
The Site and the Seller disclaims that your use of the Site will be error-free.
Although the Seller does their best to provide helpful, accurate, and complete information, it does not warrant or guarantee, or make a representation of any kind, regarding the accuracy or reliability of information available on the Site.
Your use and/or purchase of products from the Site and/or Seller are at your own risk. The Site and Seller are not liable to you or any other person or entity for any loss (direct or indirect), damages of any kind (i.e., direct, consequential, punitive, special, etc.), injuries, lawsuits, or harm experienced as a result of any products purchased from the Site and/or Seller.
PRODUCT & SERVICE DISCLAIMER
Educational Purpose: All products and services offered through the Color Mending Therapy online store — including digital courses, programs, sessions, materials, and practitioner certifications — are for educational purposes only. They are designed to teach emotional regulation skills and the Color Mending Therapy methodology, not to diagnose, treat, cure, or prevent any mental health condition or psychological disorder. No therapeutic, clinical, or counselor-client relationship is formed through the purchase or use of any product or service in this store.
Not Mental Health Treatment: Color Mending Therapy products and services are not therapy, counseling, or mental health treatment, and are not a substitute for professional mental health care, psychiatric treatment, or medical advice. Our products and services are intended for individuals who are not currently experiencing active, untreated mental health conditions. If you are experiencing a mental health crisis, severe symptoms, or are currently under the care of a mental health professional, consult with your provider before purchasing or using any Color Mending Therapy products or services. If you are experiencing a mental health crisis, suicidal thoughts, or symptoms of a serious mental health condition, seek immediate help from a qualified mental health provider or emergency services.
Practitioner Certifications: Practitioner certification programs offered through this store are educational training programs in the Color Mending Therapy methodology. They do not constitute licensure in any mental health, counseling, or medical profession, and do not qualify certified practitioners to provide therapy, counseling, or clinical mental health services.
Individual Results & Responsibility: Your experience with Color Mending Therapy methodology and materials is individual and cannot be guaranteed. You are responsible for your own emotional well-being and for seeking appropriate professional support when needed. We make no claims about specific outcomes, healing, or therapeutic results from using our products or services.
Physical Products: Any physical products — including coloring materials, workbooks, and printed charts — are intended for their stated educational purpose. Use as directed and discontinue use if any physical irritation or reaction occurs.
Jurisdiction: The availability and legality of educational wellness products and services varies by location. It is your responsibility to verify that your purchase and use of these products and services is permitted under the laws of your state or jurisdiction.
PRODUCT & SERVICE DELIVERY
Digital Products: All digital products (courses, programs, workbooks, guides, and downloadable materials) are delivered electronically. You are responsible for ensuring you have compatible devices and software to access digital content. Digital products are non-returnable once accessed.
Live Sessions & Programs:
Scheduling: Color Me Psychic sessions and 1:1 coloring sessions require advance scheduling and are subject to availability.
Cancellation & Rescheduling Policy:
You may cancel or reschedule your appointment up to 24 hours before your scheduled session time at no charge
Cancellations or rescheduling requests made less than 24 hours before your session will incur a $25 late fee
No-show appointments (failure to attend without notice) will be charged in full with no refund
Emergencies & Illness: We understand that genuine emergencies and illness happen. If you're unable to attend due to sudden illness or emergency circumstances, please contact us as soon as possible at HELLO@COLORMENDING.COM or 512-758-4940. We will work with you on a case-by-case basis when you make every effort to communicate the situation promptly.
Late Arrival: Sessions begin at the scheduled time. If you arrive late, your session will end at the originally scheduled time and the full fee applies.
Gift Cards: Gift cards purchased through the Site can be redeemed for Color Me Psychic sessions and 1:1 coloring sessions with Chelsea Kells.
By purchasing or using a gift card, you agree to the following:
Gift cards do not expire
Gift cards are non-refundable and cannot be exchanged for cash
Gift cards are transferable as gifts but cannot be resold
Recipients must schedule sessions according to availability and standard booking procedures
Color Mending Therapy is not responsible for lost, stolen, or unauthorized use of gift card codes
Gift card balances and redemption codes will be provided via email upon purchase
Professional Certification Program: Certification and licensing programs have specific enrollment requirements, completion timelines, and ongoing standards. Details are provided upon enrollment.
Physical Materials: If physical coloring materials or printed workbooks are purchased, standard shipping terms apply. Colors may appear differently in print than on screen.
PRICES
Prices are subject to change without notice. We reserve the right to modify, change, or alter our prices at any time. We are not liable to you for any price change.
TRANSACTIONS
The Site and Seller reserve the right to refuse or cancel any order, including for pricing errors, at any time.
We reserve the right to limit the number of items you can purchase.
We reserve the right to prohibit the purchase of items for resale or distribution.
By purchasing from the Site and/or Seller, you warrant and represent you have the right to use the payment method, account, and/or credit card(s) being used to purchase the items.
REFUND & RETURN POLICY
We will do everything within our ability (and within reason) to ensure your satisfaction. Due to the downloadable nature of our products, we do not accept refunds or returns of any kind. All purchases are final. If you have any questions or concerns, or if there is anything we can do to make your experience a more pleasant one, please email CHELSEA KASEN-KELLS at HELLO@COLORMENDING.COM.
DAMAGES & SHIPPING ISSUES
If an item arrives damaged, you must notify us in writing at HELLO@COLORMENDING.COM within 48/HOURS of receiving the item, and provide us with your order number and/or receipt, and pictures of the damaged product.
If you have received notification that an item has been delivered to your shipping address but you have not received the item, you must notify us in writing at HELLO@COLORMENDING.COM within 48 hours to notify us of the issue. You must also contact the mail carrier responsible for delivering the item to resolve the issue with the carrier. We are not responsible for the carrier’s failure to deliver the item.
CANCELLATION POLICY
Cancellations are not accepted once an order is placed.
SHIPPING POLICY
We aim to ship your products within 3 business days from the time of your purchase.
NO CLAIMS MADE REGARDING RESULTS
The Site and the Seller do not guarantee, warranty or mean to imply in any way that you will achieve a certain result, cure, positive outcome, or experience as a result of use or purchase of our products.
INTELLECTUAL PROPERTY
The Site and/or the Seller own the intellectual property rights to the design, name(s), and creation of the products purchased on the Site and from the Seller. You are not authorized to resell or distribute the Seller’s items in any way. If you are interested in becoming a distributor of the Seller’s products, please contact HELLO@COLORMENDING.COM.
ARBITRATION CLAUSE
If you have any complaint or should any issue arise in the use of the Site or the Seller’s products, please contact us directly first by emailing us at HELLO@COLORMENDING.COM.
If we are unable to amicably resolve your dispute in that manner, you agree that you and the Seller shall submit your dispute to binding arbitration with the American Arbitration Association, before an arbitrator that is mutually agreed upon, in accordance with the American Arbitration Association’s (“AAA”) rules.
By agreeing to this clause, you hereby agree and understand that you’re waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 25 miles of Austin, Texas.
If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court in the State of Texas. The only award that can be issued to you is a refund of any payment made to KASEN-KELLS CONSULTING, LLC for the applicable Product. You are not permitted to seek additional damages, including consequential, special, or punitive damages.
CONSENT TO GOVERNING LAW
The Terms, and any dispute arising out of it, shall be governed by the laws of the State of Texas.
CONSENT TO JURISDICTION
You hereby irrevocably consent to the exclusive jurisdiction and venue of any Federal Court in the United States District Court for the District of Texas or a state court located within the State of Texas in connection with any matter arising out of the Terms and/or your purchase from the Site and/or the Seller.
CONSENT TO SERVICE
You hereby irrevocably agree that process may be served on you in any manner authorized by the Laws of the State of Texas for such persons, and you waive any objection which you might otherwise have to service of process under the laws of the State of Texas.
DEFENSE & INDEMNIFICATION
You shall, at all times, indemnify, defend, and hold harmless the Site, the Seller, and all of our shareholders, officers, members, affiliates, contractors, subcontractors, directors, assignees, employees, and licensees from and against all losses, damages, injuries, delays, deaths, lost profits, and expenses arising out of any proceeding (a) brought by either a third-party or by the Site and/or the Seller; (b) arising out of your breach of your obligations, representations, warranties, or covenants under the Terms; and (c) arising out of any alleged breach or negligence said to have been committed by you.
TERMINATION OF YOUR USE
At our sole discretion, we are permitted to terminate your use or access to the Site and/or the products if you abuse, violate, or breach any of the Terms.
ENTIRE AGREEMENT
The Terms constitute the entire agreement between you, the Site, and/or the Seller with respect to the Site and/or the products, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us with respect to the Site and the products.
SEVERABILITY
The provisions of the Terms are severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision herein. If any paragraph, section, subsection, sentence, or clause of the Terms are rendered illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on the Terms as a whole or on any other paragraph, section, subsection, sentence, or clause herein.
